Proskauer Welcomes Former SEC Branch Chief David J. Marcinkus to its Market Leading Registered Funds Group
Proskauer, a leading international law firm, today welcomed former U.S. Securities and Exchange Commission Branch Chief David J. Marcinkus as a Senior Counsel in its Registered Funds Group, based in Washington, DC.
As a former Branch Chief for the SEC’s Division of Investment Management, David specialized in regulations with respect to business development companies or "BDCs" and permanent capital vehicles, and was a member of the BDC and closed-end fund offering reform rulemaking team. David also served as a member of the rulemaking team responsible for the long-awaited new fair valuation rule for registered funds and BDCs, and advised the Chief Counsel's office on status and disqualification matters arising under the Investment Company Act. He also assisted the SEC’s Division of Examinations on deficiency matters involving registered and private funds and their sponsors, and assisted with broader disqualification and “bad actor” matters for industry participants.

David received his B.A. from Boston University and his J.D. from The George Washington University Law School.
