A law firm in Asheville, NC, is seeking a seasoned Trademark Attorney with over four years of specialized experience. The successful candidate will handle a diverse portfolio of trademark cases, providing expert advice and legal services in trademark registration, enforcement, and litigation. This role requires a deep understanding of trademark law, strong analytical skills, and the ability to manage complex client needs in a dynamic environment.

Duties:

  • Conduct and analyze trademark searches and evaluate risks associated with trademark use.
  • Prepare and prosecute trademark applications at the USPTO.
  • Represent clients in trademark opposition and cancellation proceedings before the TTAB.
  • Manage and oversee international trademark registrations and disputes.
  • Provide strategic advice to clients on managing and protecting their trademark portfolios.
  • Negotiate and draft intellectual property agreements, including licensing and settlement agreements.
  • Engage in trademark litigation, including preparing pleadings, discovery, and motions.
  • Counsel clients on intellectual property matters, including copyright, domain names, and related rights.
  • Maintain up-to-date knowledge of legislation and judicial decisions that affect trademarks and intellectual property law.

Requirements:

  • Must possess a Juris Doctor (JD) degree from an accredited law school.
  • Admitted to practice law in at least one U.S. state; admission to the North Carolina Bar is preferred.
  • At least 4 years of experience in trademark prosecution, litigation, and counseling.
  • Demonstrated proficiency in managing a large docket of trademark cases.
  • Strong familiarity with USPTO procedures, international trademark laws, and the Madrid Protocol.
  • Excellent judgment, meticulous attention to detail, and the ability to handle complex legal issues.

Education:

  • Juris Doctor (JD) from an accredited law school.

Certifications:

  • Admission to a U.S. State Bar; North Carolina preferred.
  • Registered to practice before the United States Patent and Trademark Office (USPTO) is highly advantageous.

Skills:

  • Exceptional written and verbal communication skills.
  • Advanced analytical, organizational, and negotiation skills.
  • Strong client service orientation with the ability to handle sensitive and confidential information.
  • Proficient in using legal database software for trademark management.
