A law firm is seeking a Healthcare Data Privacy Associate Attorney to join their global Data Privacy, Cybersecurity, and Digital Assets Practice Group in Miami. The candidate will play a crucial role in advising clients on digital healthcare privacy, data privacy, cybersecurity, and digital assets counseling. They will work closely with partners worldwide, taking on significant responsibilities for projects and direct client interactions. The role involves conducting compliance gap assessments, implementing remediation plans, drafting policies and procedures, advising on contract and M&A negotiations, and providing incident response expertise.

 

Duties:

  • Assist and advise clients on digital healthcare privacy, data privacy, cybersecurity, and digital assets counseling and transactions.
  • Lead or assume significant responsibility for projects, working directly with global partners and clients.
  • Conduct compliance gap assessments and implement remediation plans.
  • Draft policies and procedures, including privacy policies, privacy statements, incident response plans, vendor contracting templates, and DPAs.
  • Provide advice on contract and M&A negotiations.
  • Assist clients in determining compliance risks and priorities, implementing data protection compliance, and developing information governance programs.
  • Utilize healthcare industry experience to address industry-specific challenges.

 

Requirements:

  • J.D. degree or equivalent.
  • Admission to practice and in good standing in any U.S. state.
  • 4+ years of relevant experience, with meaningful knowledge of healthcare industry data privacy and security issues (e.g., info blocking).
  • Incident response experience is desirable.
  • Digital healthcare and privacy experience are strongly preferred.

 

Certifications:

  • Certified Information Privacy Professionals are strongly preferred.
  • Specifically, CIPP-US, CIPP-EU, and CIPM certifications.

 

Skills:

  • Strong understanding of international, federal, state, and local privacy and security laws.
  • Familiarity with technologies supporting compliance.
  • Industry experience and/or experience drafting privacy and security policies for compliance with various regulations and guidance, including FDA, FTC, HIPAA, GLBA, and more.

 

Education:

J.D. degree or equivalent.
