A law firm seeks a Bankruptcy Associate Attorney for its Chicago, Illinois, office to support the Commercial Bankruptcy, Restructuring, and Creditors’ Rights practice. The successful candidate will handle diverse insolvency matters, from bankruptcy filings through post-confirmation work, and participate in related receiverships, guaranty actions, and trust sales. This hybrid role combines in-office collaboration with remote responsibilities.

Duties

  • Guide clients through all stages of Chapter 7, 11, and 13 proceedings, including preparing petitions, schedules, and plan documents

  • Manage motion practice and discovery tasks—drafting pleadings, responding to objections, and arguing before bankruptcy and district court judges

  • Conduct preference analyses, negotiate and litigate fraudulent transfer claims, and resolve contested claims against estates

  • Advise on debtor-creditor workouts, negotiating forbearance agreements, and structuring pre-bankruptcy restructurings

  • Oversee receiverships and execute guaranty enforcement actions, coordinating trustee sales and asset liquidations

  • Support enforcement and defensive litigation in federal and state courts, including related adversary proceedings and ancillary bankruptcies

  • Perform comprehensive legal research and draft memoranda on intricate bankruptcy, restructuring, and creditors’ rights issues

  • Collaborate with senior partners and multidisciplinary teams to develop case strategies, prepare for hearings, and finalize courtroom presentations

Requirements

  • 3–6 years of experience in commercial bankruptcy and creditors’ rights, including hands-on exposure to motion practice, discovery, trial, and claims resolution

  • Familiarity with receivership protocols, guaranty litigation, and trustee sale processes

  • Demonstrated experience with federal and state civil litigation, both offensive and defensive, related to insolvency and creditor enforcement

  • Exceptional research skills, with the ability to synthesize statutory, regulatory, and case law nuances into actionable strategies

  • Strong drafting abilities for pleadings, motions, and restructuring agreements, reflecting meticulous attention to detail

  • Capability to manage heavy caseloads independently while maintaining consistent client and team communication

  • Proficiency in industry-standard bankruptcy software and e-filing systems

Education

  • Juris Doctor (J.D.) from an ABA-accredited law school

Certifications

  • Active membership in good standing with the Illinois State Bar

  • Bankruptcy certification or membership in a local insolvency bar association preferred but not required

Skills

  • Advanced legal research using Westlaw, LexisNexis, and PACER databases

  • Expertise in drafting complex restructuring documents, including plans of reorganization and disclosure statements

  • Strong oral advocacy for bankruptcy, district, and appellate court proceedings

  • Proven negotiation skills for out-of-court workouts and creditor-debtor settlements

  • Excellent time-management and organizational abilities to balance competing deadlines
