Job Title: Transactional/HOA And Condo Attorney

Job Overview: A law firm is seeking a skilled attorney to handle transactional matters for homebuilder and developer clients, focusing on the formation and maintenance of homeowners' associations (HOAs) and condominium associations. The attorney will also assist with community development matters and maintain regular client communication.

Duties:

  • Provide representation to homebuilders and developers regarding homeowner, condominium, and community associations.
  • Prepare, record, and file organizational documents for homeowner, condominium, and community associations (Declaration, Bylaws, Articles of Incorporation, Rules and Regulations, etc.).
  • Draft and finalize easements, maintenance agreements, and similar instruments related to developments.
  • Review plats, plans, titles, and other due diligence documents to prepare community, homeowner, and condominium association documents.
  • Analyze provisions of contracts about homeowners, condominiums, and community associations.
  • Draft retail sales disclosure packages and addenda for distribution to contract purchasers, including those required by HOA or Condominium Acts.
  • Prepare, record, and analyze declarations related to deferred water and sewer charges or front-foot benefit charges.
  • Maintain knowledge of statutes affecting homeowners, condominiums, and community associations, conduct legal research, and advise clients accordingly.
  • Perform other related duties as assigned.

Requirements:

  • License to practice law in Maryland or ability to become licensed in Maryland.
  • Strong preference for at least 4 years of transactional experience in homeowners associations, condominium associations, real estate, corporate governance, contract review, or fair housing.
  • Strong writing skills, including the ability to draft contracts and legal documents clearly and concisely.
  • Experience drafting and negotiating contracts for the sale and purchase of commercial real estate is favored.
  • Analytical skills necessary for complex legal analysis.
  • Interpersonal skills to communicate effectively with clients, attorneys, and staff.
  • Strong organizational skills and ability to multitask to manage multiple ongoing tasks for various projects.
  • Proficient computer skills.

Education and Certifications:

  • Juris Doctor (JD) degree from an accredited law school.
  • Admission to the Maryland State Bar or eligibility for admission.
