A law firm in Omaha is seeking a Workers' Compensation Attorney to defend workers' compensation cases on behalf of employers or insurers. The candidate will be responsible for gathering medical evidence, conducting depositions and discovery, performing legal research, drafting legal documents, and litigating cases before workers' compensation judges or referees. Additionally, the attorney will represent the interests of the employer or insurer at various proceedings, communicate with claims representatives, manage workers' compensation costs, negotiate settlements, and perform other related duties as assigned. The ideal candidate should have a J.D. and be licensed to practice law in Nebraska, with a proven track record of progressive experience in Workers' Compensation defense. General Liability experience is a plus.

 

Duties:

  • Defend workers' compensation cases on behalf of employers or insurers.
  • Gather medical evidence and records relevant to cases.
  • Take depositions of claimants, physicians, and other parties involved.
  • Conduct discovery and perform legal research on relevant legal issues.
  • Remain current with developments in workers' compensation law.
  • Draft pleadings, motions, briefs, opinions, and other legal documents.
  • Litigate cases before workers' compensation judges or referees.
  • Represent the employer or insurer at hearings, trials, mediations, arbitrations, and other proceedings.
  • Communicate with claims representatives and provide updates on case developments.
  • Monitor loss run reports for trends and concerns, and alert management accordingly.
  • Assist in accident investigations and problem areas analysis.
  • Manage workers' compensation costs to reduce liability.
  • Compile and submit reports required by company management.
  • Coordinate and attend claims reviews.
  • Negotiate settlements on behalf of the insurance company.
  • Perform other related duties as assigned, following EEO guidelines.

 

Requirements:

  • Juris Doctor (J.D.) degree and admission to the Nebraska Bar; admission to the Bar in another Midwest state is a plus, particularly Iowa.
  • Proven track record of progressive experience in Workers’ Compensation defense; General Liability experience is advantageous.
  • Working knowledge of legal principles, practices, and local, state, and federal laws and regulations.
  • Thorough knowledge of legal research techniques and terminology.
  • Experience with Microsoft Word required; familiarity with Time Matters legal software preferred.
  • Outstanding organizational, interpersonal, research, and administrative skills.
  • Excellent telephone and writing skills.
