New York City office of our client seeks mid-level intellectual property litigation associate attorney with 3+ years of patent litigation experience (including trial work) in the fields of electronic engineering, telecommunications, computer software, life sciences, biotech, or biomedical engineering before federal courts, the ITC, and the Patent Trial and Appeal Board (PTAB); preparing for taking and defending fact and expert depositions; reviewing submissions to or office actions by the U.S. Patent and Trademark Office. The candidate will oversee all aspects of Intellectual Property (IP) litigation cases and analyze the legal and factual background of patent-related opinions in order to apply federal patent laws and regulations to ongoing IP litigation matters in the fields of electronic engineering, telecommunications and computer software. Will serve as primary point of contact for clients, outside advisors, opposing counsel, technologists and industry experts. Coordinate efforts of attorney teams involved in IP litigation matters, including attorneys for other clients involved in joint defense groups. Review and revise various patent litigation documents drafted by junior attorneys. Prepare fact and expert witnesses for depositions and/or trial; manage experts in various aspects of IP litigation, including working with experts to prepare expert reports. Take and defend depositions relating to IP litigation; assist with reexamination requests, Inter Partes Review (IPR) petitions, Covered Business Method (CBM) petitions, and reissue requests for submission to the U.S. Patent and Trademark Office (USPTO) and European oppositions before the European Patent Office. Prepare detailed internal memoranda and other reports regarding legal and technical research, and factual analysis of documents and other information; direct and implement prior art search efforts. Assume significant responsibility for Markman process, including identifying key patent terms, and developing constructions, briefing and hearing presentation; research and draft business pitch materials for potential and/or existing clients. Prepare court documents, including pleadings, discovery requests, subpoenas, substantive briefs, disclosures of infringement and invalidity contentions, motions in limine, motions to transfer venue, motions for summary judgment, and responses to the aforementioned; and preparation of articles and other materials for internal and/or external dissemination regarding current developments in IP litigation. Must have a Bachelor's degree (or foreign equivalent) in an Engineering or an equivalent field. Must have experience of working on pitches and proposals to clients for new matters including: preparing draft pitch/proposal materials; supervising junior attorneys and support staff; drafting substantive briefs, pleadings, appeals for IP litigation cases for both Federal Courts and the International Trade Commission.
