Job Overview
A law firm is seeking an eDiscovery Counsel to join its eDiscovery resources team in New York. This role focuses on leading complex discovery matters involving electronically stored information (ESI). The position combines legal strategy, technology, and litigation support to guide case teams and clients through the full discovery lifecycle, including preservation, collection, review, analytics, and production. The role is highly collaborative and involves advising attorneys and clients on discovery strategy, risk management, and emerging technologies used in modern litigation.

Duties

  • Develop and implement discovery strategies from early case assessment through trial and post-trial stages
  • Advise litigation teams on preservation obligations, legal holds, and defensible collection and review practices
  • Lead negotiations with opposing counsel regarding ESI protocols, search methodologies, production formats, and proportionality considerations
  • Identify and manage risks related to discovery, including potential sanctions exposure and privilege issues
  • Advise on identifying key custodians and relevant data sources across structured and unstructured data environments
  • Support data mapping initiatives with clients and internal teams
  • Design early case assessment approaches using analytics and technology-assisted tools
  • Oversee document review workflows, including responsiveness determinations, issue coding, confidentiality designations, and privilege analysis
  • Implement defensible review processes using predictive coding, analytics, sampling methods, and validation techniques
  • Guide privilege management, including logging strategies, redactions, and clawback agreements
  • Manage discovery budgets, forecasting, and cost control strategies
  • Supervise document review teams and coordinate with internal staff and external vendors
  • Train attorneys and staff on eDiscovery practices, technology tools, and evolving workflows
  • Monitor developments in eDiscovery law, analytics, artificial intelligence, and emerging technologies, and integrate them into practice

Requirements

  • 8-12 years of litigation experience with substantial responsibility for discovery strategy and execution
  • Experience managing large-scale electronic document reviews and productions in complex matters
  • Background in complex commercial litigation, regulatory investigations, or white collar matters preferred
  • Demonstrated ability to advise clients and senior stakeholders on discovery strategy and risk management
  • Strong ability to manage multiple complex matters simultaneously while meeting deadlines

Education and Certifications

  • Juris Doctor (JD) from an accredited law school
  • Active membership in good standing with at least one United States state bar
  • Admission, or eligibility for prompt admission, in the jurisdiction where the attorney will practice

Skills

  • Deep knowledge of electronically stored information management, including preservation, collection, processing, review, and production
  • Experience with eDiscovery review platforms and analytics tools such as Relativity or similar technologies
  • Familiarity with technology-assisted review, predictive analytics, conceptual clustering, and artificial intelligence-driven review tools
  • Strong understanding of eDiscovery law, proportionality standards, and defensible discovery practices
  • Experience managing privilege review processes and logging strategies
  • Strategic decision making and leadership capabilities
  • Excellent written and verbal communication skills
  • Strong organizational and project management abilities
