Charlotte office of a BCG Attorney Search Top Ranked Law Firm seeks a construction defect/professional liability attorney with 3-7 years of experience. The candidate will make individual and group presentations to potential clients. Will interview potential expert witnesses. Meet with clients to review case strategy. Prepare pleadings, motions and briefs, and legal research for complex matters in Superior and appellate courts. Argue motions in Superior Court and oral arguments in appellate courts. Meet with clients' expert witnesses on-site at impacted properties to investigate impacts and formulate strategy. Meet with opposing counsel and with opposing party experts. Communicate in person and by telephone, email, etc., with opposing counsel to negotiate numerous issues, including settlement and pre-mediation, and pretrial disclosures. Prepare for and attend mediations with clients, opposing parties, and opposing counsel, and negotiate a settlement, including concessions in lieu of compensation. Prepare and review settlement documents. Conduct depositions, including preparation of clients and expert witnesses and preparation for examination of adverse expert witnesses. Propound and respond to written discovery. Prepare for jury trials. Trial preparation includes review and analysis of all factual and legal issues relating to compensability, valuation, and constitutional matters. Selection of witnesses and exhibits. Preparation of written outline for examination of witnesses. Meet with clients and retained expert witnesses to prepare them for direct and cross-examination. Preparation of motions in limine and supporting briefs. Analysis of potential juror pool and selection of the jury. Prepare for and attend the pretrial conference with the judge and opposing counsel. The trial includes arguing and defending motions, jury selection, defending witness examinations, and cross-examining adverse witnesses, including expert witnesses. During the trial, meet with expert witnesses and clients evening and early morning to finalize elements of testimony. Prepare for and make opening and closing arguments to the jury. Must have a focus and interest in professional liability, specifically construction defect and construction litigation. Should be NC licensed and practice-ready. The candidate should have demonstrated the ability to maintain effective working relationships with clients, witnesses, colleagues, court officials, judges, and jurors. Demonstrated ability to analyze complex facts and evidence is required. Demonstrated ability to conduct complex litigation in trial and appellate courts, including the ability to creatively develop case strategy and tactics, is needed. Must have the ability to oversee paralegals who may assist in trial preparations as necessary. Should have excellent client service or interpersonal skills and excellent verbal and written communication skills. The ability to work under pressure and handle conflicting priorities is needed. The ability to maintain confidential information is required. The ability to work independently and as part of a team, using initiative in all aspects of assignments, is essential. Must have excellent time management skills. Strong organizational skills and attention to detail are required. Should have keen observation skills.
