Pawtucket office of our client seeks litigation attorney with 6-10 years of experience in trials, appeals, and contested foreclosure matters. The candidate will review and analyze pre and post-judgment title issues to ensure marketable title to the clients or identify potential title issues and assess resolution options. Will draft substantive pleadings, motions, and memoranda; formally appear at court hearings, mediations, depositions and trials on behalf of client. Manage and oversee overall litigation department and cases handled by less experienced attorneys. Must preferably have 3-5 years of experience in foreclosure/default servicing and some title resolution and claims work. Must be in good standing and active in preferably all state and federal courts of Rhode Island, Massachusetts and New Hampshire as well as the First Circuit Court of Appeals. Knowledge of residential foreclosure process and general real estate law, including litigation, title curative / title claims, and post-judgment litigation; Experience handling FDCPA, RESPA, and TILA claims, predatory lending/consumer claims and as well as creditor rights generally is essential. Experience with propounding discovery and assisting clients with responses to discovery requests, including identifying responsive documents is essential.

The candidate will have ability to communicate, written and verbal, with clients on issues that may affect the foreclosure, advise on possible courses of action, and assess the range of outcomes; Organized attorney able to manage a large caseload, while balancing appearances and overseeing a paralegal staff. Must be able to meet billable hour goals monthly. Must be able to manage and oversee overall litigation department and cases handled by less experienced attorneys. Must be willing to waive in to other New England states such as Connecticut, Vermont and Maine. Juris Doctor is needed. Knowledge, skills, and abilities: Intermediate knowledge of MS Office, Word, and Excel are essential.
