San Diego office of a BCG Attorney Search Top Ranked Law Firm seeks a senior intellectual property litigation attorney with 5-7 years of experience. The candidate will work closely with and provide leadership to administrative staff concerning client billing, client meetings, and invoicing, as well as finalizing client projects. Prepare various legal documents, such as motions, pleadings, briefs, and correspondence. Advise clients by weighing available options toward a successful outcome and plan a course of action. Conduct research and draft pleadings, briefs, and motions. Identify client conflicts and determine case strategies with options for resolution. Represent clients in court to argue motions during legal proceedings. Coordinate and communicate with clients. Draft and send cease and desist letters. Prepare, file, and represent clients in TTAB proceedings (cancellations and oppositions). Manage all aspects of TTAB and federal court litigation in the fields of trademark infringement, copyright infringement, and patent infringement. Negotiate various IP settlements with opposing parties/counsel. Prepare and finalize settlement agreements and consent agreements. Draft various contracts such as licensing agreements, website terms and conditions, privacy policies and forum policies, vendor agreements, consulting agreements, and the like. Handle a trademark or copyright dispute from inception all the way through resolution (via TTAB, federal court, or otherwise) with minimal oversight. Should preferably have federal litigation experience (trademark, copyright, and/or patent). Should also have some experience drafting transactional agreements. Those with patent experience and a license to practice before the USPTO are preferred. Must be licensed to practice law in the State of California.

The candidate must have excellent writing and settlement skills. Should have negotiated intellectual property and business disputes. An understanding of basic general counsel principles, including employee matters, is required. Knowledge of MS Office programs is needed. Advanced computer skills working with legal research programs (Westlaw and Lexis) are required. A basic understanding of law firm software such as Clio, AltLegal, and TMTKO is needed.
