Palo Alto office of our client seeks a trusts and estates litigation attorney with 2-5 years of experience in a legal environment. The candidate will do an initial case analysis of claims and an investigation file. Written status reporting of the file, including analysis of how discovered information and procedure affect the case. Preparation/Review of pleadings, law and motion. Prepare/draft Special Interrogatories, Requests for Production, Requests for Admission, PMK deposition notices, prepare clients for depositions, take depositions, defending depositions. Prepare case management conference statements, appearing at case management conferences. Prepare briefs and attend ADR proceedings. Do Legal Research. Prepare Motions, draft Points and authorities, and Declarations of attorneys. All aspects of Trusts and Estate litigation, including elder abuse matters, contested conservatorships, petitions for instruction, and petitions to confirm trust property. Handle probates and other trust administration matters, including substituted judgment petitions, modifications of trust, trust terminations, the establishment of special needs trusts, conservatorships, partition actions, creditor claims, and related matters. Must be a member of California Bar.
The candidate must be a graduate of an accredited law school. Strong knowledge of Trust and Estate litigation law and practice, civil procedure and evidence desired. Must have an understanding of trial litigation practices and procedures. Must have research, writing and analysis skills. Must have knowledge, Understanding, and experience of Law and Motion and Discovery (California Discovery Statutes). Must have the ability to prepare litigation budget. Must have excellent writing and communication skills. Must be proficient in computing skills, especially in the use of MS Office software (Word, Excel, PowerPoint, Outlook.). Must be proficient in using Rocketmatter or other Case Management and Billing Software. Must be proficient in using Acrobat. Must be proficient in using electronic filing in State courts. Must be a charismatic, trustworthy, a team player and proactive. Must be mature, responsible and someone who values personal growth. Must be able to take the big picture view and contribute to positive situation outcomes. Must have high attention to detail, common sense approach and need little supervision. Someone that will go the extra mile, a self-starter. Must be able to handle the pressure. Must have the willingness to work outside typical hours, as necessary. Must work independently, meet deadlines, and can make customer experience a great one.
