Pennsylvania Legislature Sued Over Defunding of adultBasic
Pittsburgh firm Caroselli Beachler McTiernan & Conboy are representing three plaintiffs in a suit filed Monday against Governor Tom Corbett, among several other state officials, for letting adultBasic expire. adultBasic is a health insurance program for states, and is for it's low-income citizens.
According to the complaint, the state is violating state law, namely, the Pennsylvania Tobacco Settlement Act, by denying funds to the adultBasic program. According to state law, the tobacco settlement money is required to go towards funding of adultBasic.
The governor, who seems to be in a not so uncommon situation, said this about the end of funding to adultBasic: ''I would remind everybody, including those people who have filed the lawsuit against whoever they have filed the lawsuit, that this was a program that was not sufficiently funded.''
However, the state receives several hundred millions from the Tobacco Settlement Act every year. According to William Caroselli, the lawyer for the plaintiffs, ''state law mandates that those proceeds go toward making Pennsylvanians healthier and that a portion be specifically directed to fund adultBasic.''
