New Orleans office seeks environmental/toxic tort 1st chair attorney having sufficient working background on medical issues relating to occupational lung diseases including pathology, chest x-rays and CT scans and pulmonary function tests. The candidate will maintain responsibility for firm tasks as defined in Environmental/Toxic Tort 1st Chair Attorney Job Description. Will maintain compliance with firm Mission, Vision and Values. Maintain compliance with firm Policy and Procedure Manual and related Non-Disclosure Covenants. Be available to record at least 2000 hours per year, whether in case specific billable hours or other firm required non-billable but creditable tasks. Enter time logged in performing case specific billable hours, planned client development or other firm required non-billable tasks into firms computerized billing system database on a daily basis. Actively participate in all firm gatherings and meetings, and support legal team as necessary in either the Northshore or New Orleans main office. Actively participate in firms client development. Understand the importance of early evaluation of cases and regular and comprehensive reporting. Handle and manage cases, including developing game plan and implementing appropriate strategy. Evaluate cases early and report to client on a regular and comprehensive basis, Review, organize and analyze leases and related documents pertaining to oil and gas activities, in conjunction with experts, to assist in the determination of potential client liability. Calendar and comply with deadlines. Perform other related duties as necessary. Work with experts and consultants on Act 312, NORM personal injury and related issues, including issues related to testing, sampling and regulatory reporting per Act 312 and Rule 29B. Should be able to research and draft motions, memoranda, pleadings, generate and prepare witness and exhibit lists, discovery and related documents with great attention to detail and an ability to fully comprehend the legal issues at hand and argue creatively and make fine legal distinctions. Should be able to argue motions and exceptions in court and attend court-ordered status conferences, discovery conferences and related court proceedings and be able to travel to them when necessary. Must be able to take depositions of plaintiffs, fact witnesses, experts and case related persons and entities, and be able to travel to them when necessary. Ability to discuss issues with experts and consultants, including selecting appropriate material to provide them and discuss pertinent case-related issues that often arise among the plaintiffs, co-defendants and other experts is required. Must be or become familiar with Act 312 oil and gas legacy and NORM personal injury litigation and related issues, experts, attorneys and co-defense counsel in those types of cases. Should be or become familiar with the Louisiana Department of Environmental Quality and Louisiana Department of Natural Resources regulations and personnel. Ability to first chair trials of Act 312, NORM and related matters is required. Should be or become familiar with case law on allocation of fault, Cole vs. Celotex. Must be or become familiar with case law on burden of proof and precedential requisites, Lucas vs. Hopeman Brothers, Vodanavich vs. A. P. Green, and Thibodaux vs. Asb. Corp. and must be familiar with cases involving substantial contributing factor, Lucas vs. Hopeman Brothers, and Quick vs. Murphy Oil. Should be able to review, organize and analyze documents related to Toxic Torts, in conjunction with experts, to assist in the determination of potential client liability.
