Megaupload Trial on Shaky Legal Ground Because of FBI Error


The judge handling the Megaupload case has informed the FBI that Megaupload has not been served with criminal charges, which is the basic requirement to have a trial. “I frankly don’t know that we are ever going to have a trial in this matter,” Judge Liam O’Grady said according to NZ Herald.

The lack of criminal charges may not be just a minor bureaucratic error on the part of FBI. Ira Rothken, Megaupload’s lawyer has said that while people outside the country can be served, companies outside the U.S. cannot be served. He believes that the lack of jurisdiction means that Megaupload cannot be served in a criminal matter.
