New York Judge Says a Law Partner is Not an Employee

New York Supreme Court Justice Marcy Friedman has ruled in favor of law firm Holland & Knight which was being sued by a former partner for age discrimination. John Weir, who was a partner in the firm, was expelled from the partnership. He was 55 at the time. Weir sued the firm in 2005 claiming that he was fired because of age discrimination and the firm did not want to pay his retirement benefits. But Justice Friedman dismissed his entire complaint saying that Weir had not shown any evidence that proved that he was not a bona fide partner of the firm.
